I got out of the mortgage by applying for a shortsale, with a shortsale
you can negotiate with the bank to let you sell your house even if its under value. Compared to a foreclosure, the shortsale is a deal with the bank to settle the mortgage whereas the foreclosure is to forgo your obligation and leave the bank with an unsettled account which I think is not halal.

To get a short sale approved you need the following:
- show a hardship so you need to sell the house
- find a real estate agent to deal with the bank for you
- find a buyer, the agent can do this
- be careful to make sure the bank forgives the promise and the mortgage
- maybe have to pay a settlement on the balance like 10K
- may take up to 8 months

the process is not easy but if you persist, inshallah it will happen. It took me 8 months to finally get the deal made.
Make sure to do dua that Allah make it easy for you.
